1. Acceptance of Terms

By accessing or using the Nestrixo website, mobile application, and related services (collectively, the Services), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and Nestrixo regarding your use of the platform.

2. Eligibility and Accounts

You must be at least 18 years old to use the Services. By creating an account, you represent and warrant that you possess the legal authority to form a binding contract.

• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Accurate Information: You agree to provide current, complete, and accurate information during registration and keep it updated.
• Account Suspension: We reserve the right to suspend or terminate your account if any information provided proves to be false, misleading, or in violation of these Terms.

3. Use of Services

Nestrixo provides a platform to connect property owners, landlords, real estate professionals, and prospective tenants/buyers. We are not a real estate broker, lender, or property manager.

• For Landlords and Posters: You are solely responsible for the accuracy of your listings, compliance with local housing laws (including the Fair Housing Act), and honoring scheduled property tours.
• For Renters and Buyers: You acknowledge that Nestrixo does not independently verify the condition of properties or the legal authority of posters to lease or sell them. You agree to exercise due diligence before entering into any agreements or transferring funds.
• Prohibited Conduct: You may not use the Services for fraudulent purposes, to scrape data, to discriminate against protected classes, or to distribute malware.

4. Tenant Screening and Background Checks

Nestrixo may facilitate tenant screening services, including credit reports and background checks, through authorized third-party providers.

• Consent: Prospective tenants must explicitly consent to background and credit checks. By consenting, you authorize our third-party partners to process your personal data.
• Compliance (FCRA): Landlords using screening reports must comply with the Fair Credit Reporting Act (FCRA) and all applicable state and local laws regarding the use of consumer reports for housing decisions.

5. User-Generated Content

Users may submit property descriptions, photographs, reviews, and other materials User Content.

By submitting User Content, you grant Nestrixo a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, and display the content in connection with operating and promoting the Services. You represent that you own or have the necessary rights to the User Content you upload, and that it does not infringe on third-party intellectual property rights.

6. Fees and Payments

Certain features of Nestrixo, such as premium listings, application fees, or rent processing, may require payment. All fees are stated in U.S. Dollars and are non-refundable unless otherwise required by law. We use third-party payment processors, and by initiating a transaction, you agree to their respective terms and conditions.

7. Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." Nestrixo EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

In no event shall Nestrixo, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, any interactions with other users, or any property-related transactions facilitated through the platform.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State in which Nestrixo'sprimary operations are based, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
